Sponsor is Otto Bock HealthCare LP located at 11809 Domain Drive, Unit 400, Austin, Texas 78758 (“Sponsor” or “Ottobock”).

TERM

The Ottobock Limb Loss & Limb Difference Awareness Month Sweepstakes (the “Sweepstakes”) will take place from April 1, 2024, to May 1, 2024.. By entering the Sweepstakes, the entrant agrees to the terms and conditions outlined in this document (“Terms & Conditions”), and warrants that his or her entry complies with all requirements set out in the Terms & Conditions.

WHO MAY ENTER

Individuals must be 18 years or older and reside in the United States and Canada. Residents of Quebec are not eligible. Healthcare professionals (individuals licensed, registered, or certified under federal or state laws or regulations to provide health care services) are not eligible. Employees of Ottobock, and its subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not they are related, are not eligible. THE SWEEPSTAKES IS VOID WHERE PROHIBITED.

HOW TO ENTER

Individuals must complete the Sweepstakes webform for a chance to win the prize. Chances of winning depend on the number of entries received.

PRIZE

Entrants will be randomly selected (the “Entry Winners”) by the Sponsor to win the following prizes on the following dates:

• May 3, 2024- Two (2) individuals, residing in Canada, will be selected to win one (1) June Adaptive clothing gift card each (each gift card is worth $250.00). 

Entry winners will be contacted by the Sponsor via the email address they provided in the webform.

If an Entry Winner is a Canadian resident, that individual must correctly answer a time-limited mathematical skill-testing question before the prize will be awarded.

Sponsor will deliver all prizes, excluding the Ariat adaptive boots, to the Entry Winners via mail to the address provided in the webform. Sponsor will provide Ariat with the address of the Entry Winner of the Ariat adaptive boots so that Ariat can mail the Ariat adaptive boots to that Entry Winner.

LIMITATION OF LIABILITY

By entering the Sweepstakes, the entrants release, discharge, and hold harmless the Sponsor and its affiliates, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Sweepstakes or any Sweepstakes-related activities and the acceptance and use, misuse, or possession of the prize awarded hereunder. These obligations shall survive the expiration, termination, cancellation or suspension of the Sweepstakes.

The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Sweepstakes entries or entry forms; or alteration of entries or entry forms. The Sponsor is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrant’s or any other person’s computers related to or resulting from participation, uploading of any materials related to in the Sweepstakes.

CONDITIONS

This Sweepstakes is not intended to induce the purchase or referral of Ottobock’s products that may be reimbursed under federal or state healthcare programs.

THE SWEEPSTAKES IS VOID WHERE PROHIBITED. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Sweepstakes are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries shall be void if the Sponsor determines the entrant to be a minor, the entry to not be an original, or if an entry is illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) they are the age of majority in their jurisdiction of residence at the time of entry and who reside in the United States and Canada (excluding Quebec) and (b) that the decisions regarding entry winner(s) are final and binding with respect to all matters relating to the Sweepstakes. All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on the Sweepstakes prize are the sole responsibility of the entry winner(s). In the event that the selected entry winner(s) of the Sweepstakes prize is/are ineligible, cannot be located or notified, or does/do not respond within two (2) days to an entry-winner phone call or email notification, or refuses the Sweepstakes prize, the Sweepstakes prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the Sweepstakes prize to another entrant.

Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with, or in any way violates, the entry process.

Failure by Sponsor to enforce any of its rights shall not constitute an implied waiver of those rights. No provision of the Terms and Conditions shall be deemed waived unless such waiver is in writing and signed by the authorized representative of the party against whom it is sought to be enforced. Waiver by either party of any default by the other party of any provision of the Terms and Conditions shall not be deemed a waiver by the waiving party of any subsequent or other default.

If any provision of the Terms and Conditions or the application thereof to any person or circumstance is determined by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions shall remain in full force and effect and shall in no way be affected, impaired or invalidated thereby, so long as the economic or legal substance of the transactions contemplated is not affected in any manner adverse to any party.

RIGHT TO CANCEL OR SUSPEND SWEEPSTAKES

If for any reason the Sweepstakes is not capable of running as planned, due to infection by computer virus, bugs, worms, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes. If Sponsor elects to cancel or terminate the Sweepstakes, Sponsor will not retain any rights in the entries.

DATA PRIVACY

Entrants agree that personal data, including entrant’s name and phone number, may be processed, shared, and otherwise used for the purposes and within the context of the Sweepstakes and any other purposes outlined in the Terms & Conditions. The data may also be used by Sponsor in order to verify the entrant's identity, address, and telephone number or to otherwise verify the participant's eligibility to participate in the Sweepstakes. Entrants have the right to access and review the entrant’s data held by Sponsor by writing to Otto Bock HealthCare LP at 11809 Domain Drive, Unit 400, Austin, Texas 78758. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein. Sponsor will not sell entrant’s contact information.
